Whatley Drake & Kallas has a long history of representing consumers and businesses injured by a variety of improper insurance schemes.
The firm currently serves as co-lead counsel in the Insurance Brokerage MDL, where claims have been brought against brokers and insurers for conspiring to increase premiums.
The firm has recently brought claims on behalf of a class of funeral homes that entered into pre-need contracts to provide funerals. The entities marketing the contracts drained the trust funds of assets, leaving the funeral homes with no money to pay for the funerals. The estimated damages are as much as a billion dollars.
In the past, the firm represented African American life insurance policy holders who paid more than white policy holders for similar coverage and recovered hundreds of millions of dollars, and the firm represented victims of the life insurance vanishing premium marketing scheme.
Cases:
American Bankers Insurance Company of Florida v. Jason Parham
This class action arbitration was filed on behalf purchasers of a manufactured home warranty plan that was sold by American Bankers Insurance Company of Florida. The arbitration demand alleges that American Bankers engaged in improper business practices by charging for unearned premiums and that the purchasers of the warranty plan received twelve months less in coverage than the plan contract required. Although a class has not yet been certified, the arbitrator determined that the arbitration agreement allowed the arbitration to proceed as class arbitration and that decision is currently on appeal in the Alabama Supreme Court.
In re Insurance Brokerage Antitrust Litigation, MDL No. 1663
Edith Kallas and WDK serve as Co-Lead Counsel and represent a putative class of purchasers of commercial and employer benefit insurance against many of the largest insurance companies and brokers in the country relating to these companies’ alleged participation in a conspiracy to manipulate the markets for insurance. To date, settlements with three of the defendants, Zurich Insurance Company, Arthur J. Gallagher, and Marsh have been reached for approximately $200 million.
Funeral Homes File Class Action Claims Against Prepaid Funeral Contracts Seller -- WDK Appointed Interim Class Counsel
Ponder Funeral Home, et al v. NPS, Inc., et al
WDK has been appointed Interim Class Counsel in a class action lawsuit filed on behalf of hundreds of funeral homes located across the country against a major seller of pre-need, prepaid funeral benefit contracts and several other affiliated companies and individuals. The lawsuit includes claims made against the seller of such contracts, National Prearranged Services, Inc. (“National”), as well as banks and insurance companies closely associated with National. The suit alleges a fraudulent scheme among the defendants arising from illegal practices associated with the sale and/or replacement of life insurance policies through companies affiliated with National.
